Jaipur : Rajasthan High Court ordered a case that recovery cannot be made after retirement of more payment made as salary in service. Pay scale can be revised as per rules, but recovery after retirement is wrong due to no fault of the employee.
Also, while canceling the recovery order, the petitioner was asked to pay the outstanding benefits within 3 months. Judge Anup Kumar Dhand gave this order on the petition of Rekha Sharma. Advocate Saugata Roy said that the petitioner retired from the post of Principal in July 2016, but issued an order on November 10, 2016 and removed the recovery.
