Bihar Olympic Association sends legal notice to IOA chief on constituting one-member inquiry panel

New Delhi, December 11 (IANS). Bihar Olympic Association (BOA) has met Indian Olympic Association (IOA) President P.T. A legal notice has been sent to Usha and it has been termed as “administrative overreach”. This notice is regarding the appointment of a single-member inquiry commission to investigate the governance structure of some states including Bihar.

The IOA President had on December 2 formed separate commissions of inquiry for Telangana, Bihar and Rajasthan based on the alleged complaints. Hemant Kumar Kalita, secretary of the boxing federation for Bihar, was appointed the investigating officer, who was to submit his report to the IOA president by December 10.

The commission was tasked with reviewing governance processes and election procedures. BOA termed this as against its autonomy and impartiality. He says that IOA took this step without following the principles of transparency and natural justice. BOA was neither given information about the complaints nor an opportunity to present its side. The BOA claims that the move weakens the federal structure of sports administration.

The notice, accessed exclusively by IANS, said the above responsibilities assigned to the single-member fact-finding commission relate to the reputation, integrity, transparency and efficiency of the State Olympic Associations, particularly my client – Bihar Olympic Association (BOA). Decreases. The respective state associations already have established administrative bodies. The appointment of an external one-member commission without prior consultation with these bodies is an undue interference in the proper functioning of the state associations.

The notice said that such interference can adversely affect the progress of the association and the players. This move of the IOA is contrary to the federal sports structure and constitutional provisions. The BOA demanded immediate revocation of the IOA order and called for a more collaborative approach to resolving complaints. Failure to do so, the BoA warned, would force them to resort to legal remedies.

The BoA has demanded that the IOA share complete details of the complaints and representations and give the BoA an opportunity to present its views.
