Bikaner Delhi court orders attachment of Bikaner House, know the matter

Bikaner : A Delhi court has ordered the attachment of Bikaner House. This order has been given due to non-payment of Rs 50.31 lakh to Enviro Infra Engineers Private Limited. The court has taken this step after the Municipal Corporation did not make the payment despite being given repeated opportunities. The next hearing is on November 29. Nekha Municipality had also filed an appeal in the Patiala House Court this year, which was rejected by the court. Court District Judge Vidya Prakash, while passing the order, said that even after the appeal was rejected, no action has been taken regarding payment of dues to Enviro Infra Engineers Private Limited. The court has instructed the municipality’s lawyer to be present at the next hearing. Attachment orders have been issued considering Bikaner House as owned by the Municipality.

What the court said – The court had said in the order passed on September 18 that the instructions of the court have not been followed. Despite repeated opportunities, the debtor has failed to comply with the direction to submit an affidavit of his assets. The Court, while agreeing with the arguments advanced on behalf of the Decree Holder (DH), found that this is a fit case for issuing attachment warrant against the immovable property of the debtor i.e. Bikaner House. This order was given on an application requesting to implement the order. The judge said that the court cannot sell the Nokha Municipality property or transfer it by gift or otherwise.

EO Balle-Bikaner House is not the property of Nekha Municipality

Municipality EO Avinash Sharma says that Patiala House Court of Delhi has considered Bikaner House as the property of Nekha Municipality, whereas this is not in my knowledge. As far as I know, Bikaner House is not the property of the municipality. He said that in 2011, two tenders were floated for construction and maintenance of STP. It had been paid.

Five lakh rupees of security deposit were outstanding, on which there was a para of audit. Out of that, Rs 3.14 lakh was recovered and the remaining amount was paid in 2020. Meanwhile, the sensor filed a suit against the municipality in the Patiala court. During the same time, no reply could be given from the municipality and the decision was taken in favor of the contractor. “I have received information from the media about the decision to attach Bikaner House in the case of Naekha Municipality. I have asked for a copy of the court order. The matter of maintenance of STP was never brought to the notice of the Delhi government. All these cases will be thoroughly investigated and action will be taken against the personnel responsible for this.”
