Jaipur : Bhajan Lal government has decided to withdraw the claim against the central government in the Supreme Court under Ashok Gehlot’s rule against the Delhi Police filing a case in the phone tapping case. Through this, the state government has given protection to the FIR of Union Minister Gajendra Singh Shekhawat registered with the Crime Branch of Delhi Police. The state government has submitted an application in the Supreme Court to withdraw the pending claim against the central government and Delhi Police.
It was said in the application that there is no merit in this case, therefore the state government wants to withdraw it. Permission to withdraw the case has been sought from the Supreme Court. According to Additional Advocate General Shivmangal Sharma, in February this year, the Supreme Court had asked the state government whether it wanted to continue the case, on which the state government had sought time from the court to reply. Additional Advocate General Shivmangal Sharma said that the record and the facts and circumstances of the case were examined, in which it was revealed that the case is not worth running in the Supreme Court on merit. Therefore, no purpose will be served by taking it forward. In these circumstances, in the interest of justice, it was decided to withdraw the case to save the time of the Supreme Court.

The Crime Branch of Delhi Police registered an FIR against Gajendra Singh Shekhawat on 25 March 2021 in the Rajasthan phone tapping case. In this, charges were made under Section 409 and 120B of the Indian Penal Code, Section 26 of the Indian Telegraph Act 1885 and Section 72 and 72A of the Information Technology Act, 2000. Against this, the state government filed a claim in the Supreme Court under Article 131 of the Constitution, demanding a stay on the action of Delhi Police. It was said in the claim that only the state of Rajasthan has the right to register an FIR in this phone tapping case. Delhi Police does not have the right to investigate.
Petition still pending in Delhi High Court
On the other hand, the state government also filed a petition in the Delhi High Court to get the FIR lodged against Shekhawat in Delhi quashed. Lokesh Sharma, the special officer of the then Chief Minister Ashok Gehlot, also filed a petition challenging the FIR in the Delhi High Court. Both the petitions are pending in the Delhi High Court.
