Jaipur News Desk: The High Court ordered the man convicted of attempting to rape a 39-year-old five-year-old girl to surrender to serve the remaining sentence. Gave two weeks time to surrender, if not surrendered, ordered to issue arrest warrant from subordinate court. The person found guilty was 20 years old at the time of the incident and is now 59 years old.
Judge Anup Kumar Dhand gave this order while rejecting the 32-year-old appeal of Shiv Prakash. According to the appeal, a case of attempt to rape a five-year-old girl was registered in Baran police station in February 1985, on which in December 1991, the Additional District and Sessions Judge sentenced him to five years in jail and a fine of Rs 500. In case of non-payment of fine amount, he was ordered to undergo a jail sentence of 6 months. This order was challenged through appeal in the year 1992, at that time the appellant was 27 years old. Advocate Pranav Pareek, appearing for the appellant, said that the case of attempted rape is not credible, there are many contradictions in it and there are no injury marks. Apart from this, there was no independent witness of the victim.
‘Investigation proves attempted rape’
On behalf of the government, advocate Manvendra Singh said that the FSL investigation proved an attempt to rape. The High Court said that to make an attempt, there must be an intention to commit the crime concerned and the act done in the form of an attempt must be proximate to the crime. In this case attempted rape. Rejecting the appeal, the court ordered the guilty person to surrender within 2 weeks, otherwise an arrest warrant will be issued by the subordinate court.
