Jaipur : Jaipur has put a stay on the education department’s order to send the teacher working in Mahatma Gandhi Government School to another school by declaring him surplus. This ban was imposed by the bench of judicial member Anant Bhandari and member Shuchi Sharma of Rajasthan Civil Service Appellate Tribunal (RATE) while hearing the appeal of the applicant teacher. RET has issued notice to two others including the Government Secretary and Director of the Secondary Education Department and has also sought their response. Sandeep Kalwania, lawyer of teacher Ganesh Dan Bittu, said that the Secondary Education Department has issued a notice for the posting of English medium teachers in the year 2022. The selection process was done. In the said selection process, teacher Ganesh was selected through walk in interview. In compliance with the selection order, Ganesh joined Mahatma Gandhi Government School (English Medium), Sinthal in the year 2022.
One year after this, in the year 2023, the department issued an order to the post of Assistant Teacher under contractual recruitment and posted a teacher on contract for one year without any vacant post. In the school, there is only one subject of English in the third grade teacher level second subject. The post was accepted. And the applicant is already working on it. Despite this, the department has posted another teacher on contract without the vacant post. Due to posting of contract teacher, he was declared surplus. At the same time, on September 14, orders were issued to post him in another school.
The general order of the department will also not be implemented
Meanwhile, the Secondary Education Department, Bikaner issued an order for the entire state on November 14 and said that the schools where more teachers are working than the sanctioned posts. They should be posted on vacant posts in other schools. But the RTE has made it clear in the order that the department’s general order of November 14 will not be applicable to the applicant. He will not be posted in any other school.
