Jodhpur : State High Court has recently lifted the ban on promotion of employees having more than two children. This decision was taken by the division bench of Chief Justice MM Srivastava and Justice Umashankar Vyas after a request made by the state government. The court made it clear that the promotion process of these employees will be subject to the upcoming decision.
The High Court had imposed a stay on 23 August 2023
Earlier on August 23, 2023, while hearing the petition of Santosh and others, the High Court had stayed the promotion of employees having more than two children. The reason for this was that under the rules issued by the state government, employees who had more than two children were not able to get the benefit of promotion.
This argument regarding promotion was put before the court
However, the state government had issued a new notification on 16 March 2023, in which a provision was made to give promotion benefits to employees having more than two children. Additional Advocate General Vigyan Shah, citing this notification in the court, said that this provision does not affect the previous promotions of the petitioners. He also said that this should not cause any hindrance in the entire process of promotion, and hence the court should withdraw its earlier order.
Court’s decision a big relief for state employees
The court accepted the request of the state government and ordered that the promotion process would not be stopped. However, the court also said that till the final decision in this matter, the process of promotion of employees will remain subject to any decision. This decision has come as a big relief to the state employees, who were waiting for their promotions for a long time. Now they will be able to pursue their careers, provided the upcoming judicial decision comes in their favor.
