Jaipur : DSP Hiralal Saini, who was dismissed after the obscene video with Jaipur lady constable and her son went viral, has got a big relief from the High Court. The High Court has canceled the dismissal order of Hiralal Saini. Justice Ganeshram Meena’s court gave this order while hearing the petition of Hiralal Saini. The court said – the government dismissed the petitioner without giving him a chance to be heard and without any inquiry. In such a situation, the dismissal order cannot be considered legal. In such a situation, the government’s dismissal order of 1 October 2021 is cancelled. At the same time, orders were given to reinstate the petitioner in service along with the outstanding salary and all the benefits.
Government may continue departmental investigation
Petitioner’s lawyer RN Mathur said- We had challenged the order of dismissal from service without investigation. We had told the court that the government did not conduct any investigation before issuing the dismissal order. At the same time, he was dismissed without giving a chance to be heard. The government said that investigation in this matter was not possible. The court did not accept this. From our side it was said that the government can issue dismissal order without any investigation only in that case in which investigation is not possible in any way. On the basis of the video footage action was taken against the petitioner. They were also not tested in any way to see if the footage was fake. However, the court has said that the government can continue the departmental inquiry against the petitioner.
Videos were made in Pushkar resort
A video of Hiralal Saini and a woman constable from the resort of Pushkar dated July 10, 2021 had surfaced. Both were seen in the swimming pool. During this time the 6 year old child of the lady constable was also with her. Both had gone to the resort to celebrate the child’s birthday. Two videos of both of them had surfaced. In both the videos, obscene acts were seen with the child. The videos surfaced 17 days after the celebration. Then the whole matter came to light. Actually, the lady constable was saving the video in a separate folder. Then the video was put on the status of WhatsApp. The woman’s brother and sister-in-law had called her and told her about the video. Many people had downloaded his video.
Husband had asked for divorce after the video came out
The woman’s husband had given a complaint to Nagaur SP after the obscene video surfaced. Which was sent to Chitawa police station for investigation. At the same time, the woman had also given a report against two people in Kalwad police station of Jaipur for making the video viral. In this, he threatened to make the video viral and demanded Rs 10 lakh. The woman’s husband started demanding divorce from her. Then there was an agreement between both of them. When the video surfaced, the RPS and constable were suspended and arrested. After this, Chitawa Police Station Officer, Kuchaman DSP along with Kalwar SHO and Jhotwara DSP were also suspended.
