Jharkhand government reaches Supreme Court against cancellation of FIR lodged against BJP MP Nishikant Dubey and Manoj Tiwari

Ranchi, November 27 (IANS). The Jharkhand government has challenged in the Supreme Court the order of the Jharkhand High Court to cancel the FIR lodged against BJP MPs Nishikant Dubey and Manoj Tiwari for allegedly flying a flight in violation of security rules at Deoghar airport.

Justice Abhay S. in the Supreme Court on Wednesday. The case was heard in the bench of Justice Oak and Justice Augustine George Masih. The High Court had quashed the FIR on the grounds that no prior approval was taken for investigation in the case as per the Aircraft (Amendment) Act, 2020.

On Wednesday, the Jharkhand government argued in the Supreme Court that there is no need to take sanction from the concerned authority to continue the investigation in this case. On this, the bench asked the Jharkhand government to file a copy of those orders in which there is no need to take sanction from the concerned authority to continue the investigation.

On the other hand, the lawyer appearing for Nishikant Dubey and Manoj Tiwari said that in such a case, to continue the investigation, sanction has to be taken from the concerned authority and on this basis the Jharkhand High Court had given the decision. Now the next hearing in this case is to be held in the Supreme Court on December 18.

This incident of dispute over the flight of a private plane from Deoghar Airport took place on 31 August 2022. In this case, an FIR was lodged at Kunda police station of Deoghar district on the complaint of DSP Suman Aman, posted in the security of Deoghar airport. In this, BJP MPs Nishikant Dubey and Manoj Tiwari were accused of violating security rules at Deoghar airport. He had put pressure on ATS to let the private plane take off in the evening.

MP Nishikant Dubey had filed a petition against this FIR in the Jharkhand High Court. After hearing this, on March 13, 2023, the High Court had canceled the FIR registered against nine people including Nishikant Dubey, Manoj Tiwari, Kapil Mishra.
