Jaipur : Jaipur High Court in the year 2009 rejected the petitions filed in the case of cancellation of admissions taken irregularly in MBBS. The petitions challenged the cancellation of admissions of Rajasthan University of Health Sciences on the basis of delay in processing, on which the court refused to interfere. The High Court gave this order on 9 petitions related to irregular MBBS admissions. The petitioners said that their admission was canceled without giving them adequate opportunity of being heard, which is a violation of the principles of natural justice. On behalf of Rajasthan University of Health Sciences, it was said that according to the Supreme Court, it is not mandatory to follow the principles of natural justice in cases of mass copying and cheating in examinations.
The court said that the petitioners took admission in MBBS in an irregular manner, which was investigated by the PK Singh Committee. Only with the consent of the petitioners the case was sent to CBI for investigation. During the CBI investigation, the petitioners were also found guilty of irregularities in the FSL report. After this, Rajasthan University of Health Sciences gave the petitioners an opportunity of hearing under the University Ordinance and canceled the admission. The petitioners challenged this in the court. The court said that any benefit obtained irregularly can be canceled even after ten years.
The matter was discussed: In the year 2009, R.P.M.T. was conducted, after which the petitioners took admission. This case came to be known as Munnabhai MBBS. When the matter came to light, the High Court formed an investigation committee under the leadership of the then Inspector General of Police PK Singh. The High Court passed an order against the culprits in March 2011 and the university canceled the MBBS degrees of these petitioners in 2017 and informed the MCI.
