Notice issued to accused of Taliban massacre in Udaipur

Udaipur : Udaipur Rajasthan High Court’s decision to grant bail to the accused in the Kanhaiyalal murder case has been challenged in the Supreme Court. Kanhaiyalal’s son Yash Teli has filed a petition in the Supreme Court challenging the High Court order granting bail. After hearing the case on Monday, the Supreme Court has issued notices to the National Investigation Agency (NIA) and accused Mohammad Javed. Petitioner’s lawyers Vikramaditya Ujjwal and Namit Saxena said- Javed was in constant touch with the main accused Mohammad Riyaz Attari. He had done Reiki of Kanhaiyalal. Trial is still going on in the case. There are about 116 witnesses in the entire case. So far, testimony of only a few people has been recorded. In such a situation, pressure can be put on the witnesses. The matter is related to a terrorist incident. In such a situation, the accused should not have been given the benefit of bail. In fact, about two months ago, on September 5, the High Court had granted bail to Mohammad Javed, accused in the Kanhaiyalal murder case. Javed is accused of being involved in terrorist activities, criminal conspiracy and illegal activities.

NIA could not prove the location
While granting bail to the accused, the High Court had said – NIA has arrested the accused only on the basis of call details. NIA has not been able to prove the location of the accused. Apart from this, there has been no recovery from the accused. He has been in jail for a long time. The trial will last long, so he is granted bail.

At that time the accused’s lawyer had argued – NIA is saying that Javed had planned to murder Kanhaiyalal while sitting at an Indiana tea-stall, but tea-stall owner Dharmendra Sahu did not confirm Javed’s arrival there that day.

NIA also says that Javed had told Riyaz after doing Reiki of Kanhaiyalal. The footage of the CCTV cameras installed at the shop proves that Javed had not gone to Kanhaiyalal’s shop.
