Patiala House Court stays the order of attachment of Bikaner House, next hearing now in January

Bikaner : In a big relief to the Rajasthan government, Patiala House Court has stayed the order of attachment of Bikaner House issued on 18 September 2024. Government’s side Additional Advocate General (AAG) Shiv Mangal Sharma presented the stand on behalf of Rajasthan government.

What is the whole controversy of Bikaner House?

Actually, the ownership of Bikaner Bhawan in Delhi is with Nokha Municipal Council. Four years ago, in a dispute of Rs 50 lakh between Nokha Municipality and a company Enviro Infra Engineers Private Limited, the court had ordered attachment of the building on November 21. But today in the court, the lawyer of Nokha Municipality clarified that Bikaner House is not their property. This is the property of the state government. The municipality also said that the company will be paid within 7 days.

It is free from attachment to the property

It has been said in the court that the confiscation order was passed unilaterally, in which the state was not given a chance to present its side. Bikaner House is a government property, which is used for public and administrative functions. This property is exempt from attachment under Section 60 of CPC. Bikaner House houses the office of the Chief Minister of Rajasthan, the Rajasthan High Court Registry, and other important offices including the Additional Advocate General. The Court acknowledged the primary strength of the state government’s arguments and the significant importance of the property. The court put a stay on the attachment order and fixed January 7, 2024 for the next hearing.
