Jaipur : Rajasthan High Court expressed concern over plots and houses being sold in private colonies without proper drainage, electricity and water facilities. Also directed the state government, development authorities and urban bodies that no developer/builder should be allowed to sell plots and houses in approved private colonies without following all the construction rules. The Secretary, Urban Development and Housing Department (UDH) has been asked to issue necessary instructions in this regard to all development authorities and bodies of the state. A division bench of Chief Justice MM Srivastava and Justice Madan Gopal Vyas passed the order on PILs filed by residents of Ansal Sushant City and Sushant Lok Residents Welfare Society.
Now the hearing will be held in the last week of this month. In the petitions, the issue of lack of drinking water and other basic facilities in both the residential colonies approved by Jodhpur Development Authority (JDA) was raised. Senior advocate Rajesh Panwar, appearing for the authority, said that under the Rajasthan Township Policy, 2010, it is mandatory for the developer to develop necessary facilities in an area of more than 10 hectares. Only after that the completion certificate is given. The division bench raised the question as to how the authority gave permission to sell plot houses without ensuring facilities.
Development authorities ensure that
The court said that the authorities should ensure the availability of basic facilities like drainage, electricity and water, only then permission to reside in the colony should be given. Government, authorities and bodies should ensure that buyers are not cheated and construction is carried out as per the plan.
