Jaipur : Rajasthan High Court, taking seriously the situation of pregnant rape victims, said that if these women are not given timely information about their right to abortion, not only their lives are at risk, but many times the child is also at risk. One is forced to give birth also. The court said that until legal provisions are made to avoid such situations, the problem will be solved by setting guidelines through a court order.
The division bench of Chief Justice MM Srivastava and Justice Umashankar Vyas gave this order on appeal in the case of a minor rape victim. The court said that the government and investigating agencies are not bound to give rape victims the vital right to abortion.

Expressing the need to set guidelines until appropriate law is made, the court ordered filing of the petition on its own motion. The division bench refused to interfere with the order of the single bench not to allow abortion to the victim. The court said that the victim is 32 weeks pregnant and now abortion is in danger to her life, hence abortion cannot be allowed.
