Jaipur : Jaipur High Court lifted the ban on promotion of employees having more than two children. However, the court said that the promotion petition of these employees will remain subject to the upcoming decision. The division bench of Chief Justice MM Srivastava and Justice Umashankar Vyas gave this order on the basis of the application submitted by the state government for amendment in the stay order.
The High Court had stayed the promotion on August 23 on the basis of the petition of Santosh and others in this case. Additional Advocate General Vigyan Shah told the court that the Personnel Department issued a notification on March 16, 2023, making a provision to provide relief to employees with more than two children who were deprived of promotion. He said that this provision does not affect the earlier promotions of the petitioners, hence the entire promotion process cannot be stopped through an interim order. Therefore, the order given earlier should be withdrawn. On this the court accepted the request of the state government.
