Churu : Rajasthan High Court’s single bench of Justice Arun Monga has given a big decision in the FIR related to SC-ST Act registered against actors Salman Khan and Shilpa Raj Kundra. Order has been given to cancel the FIR against Shilpa Shetty. Actually, this whole matter was related to an interview, which was shot in the year 2013. An FIR was lodged in the Kotwali police station of Churu against the statements given by actors Salman Khan and Shilpa Shetty during that interview. Whereas SC ST Act 2015 has been amended. In such a situation, a case was filed in 2017 regarding the incident of 2013, which is not even under the provisions of the Act.
The matter was related to the shows of 2013 and 2017.
On December 22, 2017, Ashok Panwar of Valmiki Samaj had filed a case against Salman Khan and Shilpa Shetty under the SC-ST Act at the Kotwali police station in Churu. He said that the word ‘Bhangi’ was used by Shilpa Shetty in a 2013 TV interview, in which actor Salman Khan was also present. According to the complaint given to the police, the use of this word had allegedly hurt the sentiments of the Valmiki community. After the case was registered, the investigating officer issued a notice on 18 January 2018.
Filing FIR without inquiry is illegal: HC
During the hearing, the High Court said that for a crime to be certified under the SC/ST Act, intention to hurt someone is necessary, which is not visible in the applicant’s case. The High Court also made it clear that for registering an FIR under the SC-ST Act, it is necessary to conduct section and preliminary investigation. It is illegal to register FIR under SC-ST Act without inquiry.
