Jaipur : Rajasthan High Court has ordered the reinstatement of a constable dismissed 24 years ago. Also, it said that all service benefits should also be given to the petitioner constable from the date of acquittal by the Supreme Court on April 27, 2016 in the case of death in custody. Judge Ganesh Ram Meena gave this order while disposing of Rajesh Kumar’s petition. The court quashed the order of October 19, 2000 of the Superintendent of Police of Jhalawar and the order of January 27, 2003 of the Deputy Secretary of the Home Department to dismiss the petitioner constable. Also, the petitioner was considered entitled to get all notional benefits for the period from the dismissal order till acquittal by the Supreme Court. Advocate Dr. Vibhuti Bhushan Sharma, on behalf of the petitioner, told the court that a case was registered in the year 1999 in Gangdhar police station of Jhalawar against the petitioner and other constables regarding the death in custody of Radheshyam Darji.
The subordinate court sentenced all of them to life imprisonment, the Supreme Court acquitted the petitioner in April 2016. In the case of remaining absent without informing, Jhalawar SP dismissed the petitioner in October 2000 and the Deputy Secretary of Home Department rejected the appeal against the dismissal order. The petitioner said that neither a show cause notice nor a charge sheet was given to the petitioner. Apart from this, Tej Singh has been reinstated after being acquitted by the subordinate court in the same case. In such a situation, the petitioner should also be reinstated and given all service benefits.
