Jaipur : If you also own a car and your car is in bad condition. If the company is not listening to you, then you can also knock the door of the Consumer Commission. A woman living in Rajasthan did the same and the commission ruled in her favor. In fact, in an important decision, the Rajasthan State Consumer Commission has ordered a fine of Rs 8.50 lakh on Mercedes Benz India and its dealer T&T Motors. This decision came when the commission heard the complaint of customer Shaivali Paliwal, who had complained about buying a bad Mercedes Benz car.
Bought a car whose price was more than 50 lakhs
The order was given by a bench of judicial member Atul Kumar Chatterjee and member Ram Phool Gurjar of the commission. Shaivali Paliwal had purchased a Mercedes Benz car worth Rs 57,88,439 on November 24, 2017. She paid an amount as down payment and decided to pay the rest in installments. However, the car had several technical flaws, including the braking system, which could not be fixed. As a result, Paliwal could not use the car and returned it to the company.
Know why the company had to pay a fine to the customer
The commission found that the company had sold a defective car, which is a case of serious service defect and unfair trade practice. Due to this, the customer could not use the car, and the car was driven only by the company’s technical driver. Apart from this, the commission has ordered the opposite companies to pay interest at the rate of nine percent per annum from July 5, 2018 till payment on the amount of Rs 19,05,980 given to the customer as down payment and other expenses.
